Terms & Conditions

Your reservation and the accommodation agreement is made with Tioman Dive Resort (TDR) respectively B&J Dormitory, which are both owned and operated by B&J Diving Centre Sdn. Bhd. (hereto referred to as TDR). Any reservation whether made by you directly or via a third party such as a travel agent or online booking engine will be subject to these Reservation Terms and Conditions and the Reservation Privacy Policy set out below. When you make your reservation, whether online, email, text message or by telephone, you will be deemed to have read, understood and accepted these Reservation Terms and Conditions and the Reservation Privacy Policy.

If you make your reservation via a travel agent or other third party, then you have a separate legal relationship with that party and TDR has no liability for any acts or omissions of such party including their observance of your data protection rights.

When you make your reservation, you will be also deemed to have read, understood and accepted the terms and conditions for using the TDR website (which shall mean www.tiomandiveresort.com or any related TDR web pages accessible from it) and any relevant terms and conditions shall be deemed to be incorporated into your reservation and the accommodation agreement with TDR. RESERVATIONS PROCEDURE AND POLICIES

1. Reservation:

TDR website enables you to check the accommodation offerings and availability of TDR rooms or Dormitory beds and then submit an online reservation request. On completion of the reservation process you will receive a "Reservation Received, Pending Confirmation" email that includes your reservation details. Bookings are accepted subject to room availability.

At all times during the booking process, you will be advised to ensure the accuracy of your booking details (guest details, stay dates, room types, room rates, number of guest(s). TDR will not be responsible or liable for errors in booking details. We will not be under the obligation to refund or modify the booking should you fail to give us reasonable notice of any error in the booking details prior to the check-in date.

2. Room & Package Rates

Room rates and details are correct at the time of publication and are subject to change without notice.

We reserve the right to correct errors in both advertised and confirmed prices. We will do as soon as we become aware of the error.

Package rates are based on the price of the respective room, meal plan and diving activity. If a preferred room type is not available, we will book the next best available room and the package price might be adjusted accordingly.

3. Tourism Tax (TTx) & Sustainability Fee

Pursuant with the Tourism Tax Act 2017, a charge of MYR 10.00 per room per night Tourism Tax (TTx) will be levied on foreigners tourist(s).

A Sustainability Fee by the state of Pahang of MYR 3.00 per room per night will be charged.

4. Payment & Room Deposit

It is necessary to provide credit card details or make payment via bank transfer, PayPal or other payment method as stated on the check-out page to secure a room reservation.

TDR may authorize the room rate prior to arrival and reserve funds, including taxes, on the credit card to determine the validity of the credit card. Rooms booked with an invalid credit card are subject to immediate cancellation.

5. Cancellation Policy, Refund Policy, Amendments & Unused Services

You should make any cancellations or amendments at least 14 days prior to your arrival via email to reservation@tiomandiveresort.com.

You can cancel free of charge until 14 days before arrival
You will be charged the total price of the reservation if you should cancel in the 14 days before arrival.
No refund on payment shall be given and payment in full must be made if not done so already, should you decide within less than 14 days to arrival to
Shorten your stay
Arrive later than your initial booking date
No refund on payment shall be made for unused services, i.e. if a guests decides not to utilize a booked room, dive course, fun dive or other service. Full payment for any booked service is due prior to departure, weather fulfilled or not.

6. Minimum Stay

A minimum stay of 2 nights at TDR is required if you come of a weekend, a minimum of 3 nights is required if you come over a public holiday.
There is no minimum stay requirement for B&J Dormitory.

7. Check-in, Check-out and Early Departure

Check-in time is 2:00pm, check-out time is 11:00am.
Early check-in is acceptable if the booked room(s) are available, which can only be confirmed upon arrival.
Late check-out is possible only if the room is not booked by other guests and a late check-out fee may apply.

Booked rooms will be held for check-in until 9.00 am the following day of the scheduled check-in date, after which the booking will be deemed cancelled upon no-show.

There is no refund and full payment for the entire booked duration is due should you decide to check-out earlier than planned.

9. Currency and Refunds

Reservations will be charged in Malaysian Ringgit (MYR).

A refund of a deposit or prepayment, if any, will be subject to the exchange rate applied by your payment card provider at the time of any such refund and may differ from the exchange rate applied at the time such deposit or prepayment was made.

10. No Smoking Policy

We are committed to provide smoke-free rooms to our guests. Smoking is only permitted outside of the room and ashtrays are provided on the balcony.

A room cleaning fee of MYR 200.00 will be charged should we notice that guests have been smoking inside the room.

11. Damage

You as the guest are liable for any damage caused to the booked room(s) or to TDR premises or property caused by you or any persons in your party during your stay. TDR reserves the right to retain your credit card and/or debit card details and charge or debit the costs as it deem fit to compensate for the caused damage.

12. Guest’s obligations

You agree to the terms and conditions of purchase imposed by TDR. You also agree that you are fully responsible and shall pay for all charges, fees, duties, taxes, assessments and other amounts arising out of your reservation when due.

13. Force Majeure

Neither TDR nor B&J Diving Centre Sdn. Bhd. will be liable for any change or cancellation of any reservation that is caused, in whole or in part, by events, occurrences, or causes beyond our control. Such events, occurrences, or causes include, without limitation, acts of God, terrorist activities, weather, strikes, lockouts, riots, acts of war, pandemics, earthquake, volcanic activity, ash clouds, tsunamis, fire and explosions.

14. Limited Liability and Indemnity

TDR is responsible to provide you the room(s) as booked. Neither TDR nor B&J Diving Centre Sdn. Bhd. are liable for any loss or damage of property belonging to you our your party nor are we liable to any injury or loss of life incurring by you or your party making use of our facilities or services.

You hereby irrevocably agree to indemnify and keep us indemnified against all liabilities, claims, losses and expenses, including any legal fees that may be incurred by your use or misuse of our premises and services.
